TENDER NOTICE FOR MANPOWER OUTSOURCING AGENCY FOR PROVIDING STAFF ON CONTRACT BASIS

1. The Maharashtra state commission for Protection of Child Rights, a statutory body under the Commissions for Protection of Child Rights Act 2005, invites sealed tenders from reputed “Manpower Outsourcing Agencies” for providing personnel on contract basis . 2. Scope of Work: Details of Manpower requirement on contract basis for posts aregiven in Annexure I 3. Eligibility of Bidder: The Agency should have a minimum of 3 years of experience of providing such personnel on contract basis to large reputed organizations including at least one Government Organization .“Manpower Outsourcing Agencies” should be having Headquarter/ Branch office in Maharashtra preferably in Mumbai. The agency should be registered with concerned authorities like ESI, PF, Labour Law Authorities etc at least for 3 years and should have a PAN/TAN and Service Tax Registration Number. Two institutions cannot apply together as a joint venture in which case the bid of both shall be disqualified. 4. Security Considerations: The manpower supplied by the Manpower Outsourcing Agency should not have any police record/criminal case against them. The Agency should make adequate enquiries about the character and antecedents of the persons whom they are recommending. 5. Period of Contract: The period of contract is initially for 11 months from the date of taking up the supply of manpower in pursuance of contract, unless extended further by mutual consent of the Commission and the Manpower Outsourcing Agency, after giving one day technical break, on the same terms and conditions keeping in view the performance of the agency and administrative requirements. However, the Commission reserves the right to terminate the contract at any time before the normal tenure in case the service is found to be unsatisfactory with 30 days notice. 6. Submission of tenders:Tenders should be submitted in two sealed covers. The first sealed cover should be superscribed “Techno Commercial Bid for supply of Manpower” and should contain (i) Technical Bid in the format prescribed in Annexure II and demand draft for EMD Rs 25000 and other documents mentioned therein and (ii) second sealed cover containing the “Financial Bid”. The “Financial Bid should be submitted in the format prescribed in Annexure III. In this bid the bidder is to quote only the administrative charges to be charged by the agency in terms of the percentage of the total remuneration payable to the deployed staff for the entire period of 11 months. The remuneration for the staff is given in Annexure I . The “Techno-commercial bid” should contain (i) Registration Certificate of the Firm under work contract (ii)Company profile including previous experience (at least 3 years) in the field of providing manpower on contract basis to Central govt. / State Govt establishments/ Autonomous bodies/ Corporations reputed public or private organizations (iii) Duly certified copies of the satisfactory services where the bidder is providing the services for the last 3 years (iv) Attested photocopies of the PAN Card and Service Tax Registration Number (iii) Attested photocopies of EPF and ESI registration certificates (v) The firm/agency must have a registration under the Contract Labour (Regulation and abolition )Act 1970 (vi) Attested photocopies of registration certificate with labour department (vii)Acceptance of terms and Conditions and (viii) Demand Draft towards EMD drawn in favour of “Maharashtra State Commission for Protection of Child Rights” payable at Mumbai. The EMD will be refundable without interest to the Firms/ Agencies who do not qualify for the Technical/ Financial Bid. Further if the successful bidder fails to deploy the manpower against the Commission’s requirement within 15 days from the date of award of contract , the EMD shall stand forfeited without any further notice. Techno-commercial bids that are not accompanied by these documents will be similarly rejected. Both the sealed covers should be placed in the main sealed envelope super scribed “Tender for providing staff on contract basis”. This should be addressed to The Secretary, Maharashtra State Commission for Protection of Child Rights, 3rd Floor, GTS Building, Sir Pochkhanwala Road, Worli, Mumbai – 30. 7. Last Date of receipt of tenders: The tenders complete in all respects should reach the aforementioned address on or before 06.01.2015 upto 1 pm . The tenders will be opened at 3 pm on the same day in the presence of the representatives of the participating bidders who may wish to be present. The envelopes containing the “Techno-Commercial Bid” will be opened first. Only those “financial bids “ would be opened which qualify the criteria in relation to the “Techno-Commercial Bid” as indicated above. The Competent Authority of the Commission reserves the right to annul any or all bids without assigning any reason and the decision so taken will be final and binding on all parties. Terms and Conditions: 1. The Manpower Outsourcing Agency (here forth termed as “Agency”)should be registered with the concerned Government Authorities under the Companies Act 1956 or any other equivalent statute/ PF Act/ ESI Act, and Contract Labour (R&A Act) . The Agency should provide an undertaking that they will comply with all relevant statutory requirements concerning the supply of manpower. 2. The successful Tenderer will have to deposit a Performance Security Deposit with the Commission for a sum of Rs 1,00,000 before entering of contract with the Commission as successful bidder. The Performance Security Deposit will be in the form of A/c payee Demand Draft or Bank Guarantee drawn in favour of Secretary, Maharashtra State Commission for Protection of Child Rights” payable at Mumbai. The Performance Security Deposit should be valid for a period of 60 days beyond the completion of contract period. The Security Deposit shall be liable to be forfeited in case the agency fails to sign the Agreement or fails to comply with the terms and conditions of the contract or the supply of manpower is delayed beyond the stipulated period or frequent absence from duty/ misconduct on the part of manpower supplied by the Agency. The security deposit is refundable on successful completion of the contract. No interest shall accrue on such security deposit. 3. The tenure of contract is initially for a period of 11 month with the provision of extension for another 11 months after giving a technical break provided that the services of the Agency are found to be satisfactory. However, the contract is liable to be terminated at the discretion of the competent authority of the Commission with one month’s notice in case the agency fails to comply with any of the terms and conditions or its services are found to be not satisfactory. 4. The person deployed by the successful bidder should be honest, healthy and well disciplined. Character and antecedents of these persons shall be verified and the responsibility in this regard lies with the firm. The Contracting agency/company / firm shall furnish the following documents in respect of the individual attendants who will be deployed by it in the Commission before the commencement of work: a) Detailed list of candidates short listed by the agency for deployment in the Commission b) Resume~ of the persons c) Character Certificate from a Gazetted officer of the Central/ State Govt. d) Certificate of verification of antecedents of persons by local police authority 5. The Agency has to provide Photo Identity Cards to the persons deployed by them for carrying out the work at duty place. These cards are to be constantly displayed & their loss reported immediately 6. The Agency shall replace immediately any of its personnel if they are unacceptable to the Commission because of security risk, incompetence, conflict of interest and breach of confidentiality or improper conduct upon receiving written notice from office. It shall be the responsibility of the Agency to verify the qualifications and experience of the personnel deployed. If during the course of engagement of any hired staff, it comes to notice that he/ she has misrepresented the fact about his/ her qualification/ experience, the concerned hired staff shall be immediately taken back by the Agency and suitable replacement shall be provided within 3 days time. 7. The Agency shall provide a substitute well in advance if there is any probability of the person leaving the job due to his/ her own personal reason. The payment in respect of the overlapping period of the substitute shall be the responsibility of the Agency. 8. Commission shall not be liable for any loss, damage, theft, burglary or robbery or any personal belongings, equipment or vehicles of the personnel of the Agency 9. The Agency’s personnel working at the duty place should be polite, cordial, positive and efficient while handling the assigned work and their actions shall promote goodwill and enhance the image of the Commission. The Agency shall be responsible for any act of indiscipline on the part of persons deployed by him 10. The Agency shall not assign, transfer, pledge or sub contract the performance of services without the prior written consent of the Commission 11. The Agency’s personnel shall not divulge or disclose to any person any details of office, operational process, technical know-how, security arrangements and administrative/ organizational matters. 12. The Agency shall be solely responsible for compliance with statutory obligations like provisions of Industrial Disputes Act 1947, Contract Labour (Regulation & Abolition) Act 1970, Minimum Wages Act, Employees Compensation Act, PF & ESI Act/ Shops & Establishments Act and other applicable Laws, Rules and regulations from time to time. All claims arising from the personnel deployed by the service provider under any existing Act/Rules/ Regulation shall be settled by the service provider without any implication to the Commission. 13. The person deployed shall not claim any employee- employer relationship or permanent employment against the Commission and an undertaking to this effect shall be obtained from each person deployed by the Agency in the Commission. 14. The Agency shall ensure deployment of suitablepeople from proper background after character verification by the local police, collecting proofs of identity like driving licence, bank account details, previous work experience, proof of residence and recent photographand send certified copies of the same to the Commission. Agency will withdraw such employees who are not found suitable by the Commission for any reasons immediately on receipt of such a request. 15. The persons found indiscipline or wanting in any respect in terms of official decorum at any stage is to be replaced by the agency. The Agency shall ensure proper conduct of its personnel in office premises and enforce prohibition of alcoholic drinks, chewing of tobacco, paan , smoking, loitering without work etc. 16. The Commission will not bear any expenses/ liabilities incurred in connection with food, transportation, medical or any other statutory requirement in respect of any personnel of the Agency and such liabilities will be the responsibility of the Agency only. 17. The number of staff required for each category shown in the Annexure I will be need based basis, may be increased or decreased as per the requirement of the Commission at any point of time. 18. The tenderer will be bound by the details furnished by him/her to the Commission while submitting the tender or at subsequent stage. In case, any of such documents furnished by him/ her is found to be false at any stage, it would be deemed to be a breach of terms of contract making him/ her liable for legal action besides termination of contract.
